TRUESELF PRIVACY POLICY

 

TrueSelf Systems, Inc. (“TrueSelf”, “we” or “us”) created and maintains the TrueSelf website currently located at http://trueself.io (the “Website,” and together with any successor URLs, mobile applications and other online services TrueSelf may offer, the “Service”). Your use of the Services is governed by the terms and conditions set forth below (the “Privacy Policy”) and the TrueSelf Terms of Use (collectively, the “Terms”).

BY USING THE SERVICE, YOU ACCEPT ALL OF THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY AND THE TERMS OF USE AND REPRESENT TO US THAT YOU ARE 18 YEARS OF AGE OR OLDER AND ARE LEGALLY COMPETENT TO ENTER INTO AND AGREE TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY AND TERMS OF USE. 1. Types of Information We Collect

We will not share your personal information outside TrueSelf except in limited circumstances, including:

 

· When you allow us to share your personal information, such as directing us to share your personal information with third-party sites or platforms, such as social networking sites, or disclosing your test results to third parties you designate.

· When we contract or partner with a third party to provide services on our behalf, including Services development and maintenance. We require all third parties to process your data in a manner consistent with this Privacy Policy and as permitted by applicable data protection laws.

· When we share personal information with third parties in connection with the sale of a business (including merger, acquisition, or sale of all or a material portion of its assets, change in corporate control, or insolvency or bankruptcy proceedings), to enforce our Terms of Use or rules, to ensure the safety and security of our users and third parties, to protect our rights and property and the rights and property of our users and third parties, to comply with legal process, including judicial warrant, rule, order or subpoena or in other cases if we believe in good faith that disclosure is required by law or regulation.

In addition, we may use and share any aggregate information with third parties for any reason, however you will not be personally identifiable from such information.

5. Public Venues and Social Media

If you use a message board, comment function, or other public or social media function of the Services you will be identified on those venues by the username you submit and by any other personal information you disclose in such manner.

 

Information you provide on public or semi-public venues, including information you share on third party social networking platforms (such as Facebook or Twitter) may also be viewable by other users of the Services, users of those third party platforms, and other third parties. We are not responsible for any personal information you choose to post on public or semi-public venues and we recommend careful consideration before you post such information.

6. Your Controls and Choices

We provide you the ability to exercise certain controls and choices regarding our collection, use and sharing of your information. In accordance with local law, your controls and choices may include:

· You may correct, and update your registration account.

TrueSelf does not control such other sites and is not responsible for their content, their privacy policies, or their use of personal information. TrueSelf's inclusion of such links does not, by itself, imply any endorsement of the content on such sites or of their owners or operators except as disclosed on the Services. TrueSelf expressly disclaims any and all liability for the actions of third parties, including but without limitation to actions relating to the use and/or disclosure of personal information by third parties. Any information submitted by you directly to these third parties is subject to that third party's privacy policy.

8. Children’s Privacy

The Services are not intended for use by individuals who cannot enter a legally binding contract. Accordingly, TrueSelf does not intentionally gather any personal information about individuals who are under the age of eighteen (18). If you are under eighteen (18) years of age or otherwise lack the capacity to enter into a binding contract do not use our Services. If TrueSelf becomes aware that it has collected personal information from someone under the age of majority, such information will be deleted immediately.

If you are a user of this service and a California resident under the age of eighteen (18) you may request to have your posted content or information removed from the publicly-viewable portion of this web site by contacting us directly using the contact information provided below. Some content may not be removed from internal systems or databases and in certain situations public content cannot be removed.

We do not seek or knowingly collect any personal information about children under 13 years of age. If we become aware that we have unknowingly collected personal information from a child under the age of 13, we will make commercially reasonable efforts to delete such information from our database.

If you are the parent or guardian of a minor child who has provided us with personal information, you may contact us using the information below to request it be deleted.

9. Data Security, Integrity and Retention

General. We have implemented reasonable technical, administrative, and physical security measures that are designed to protect user information from unauthorized access, disclosure, use and, modification. From time to time, we review our security procedures to consider appropriate new technology and methods. Please be aware though that, despite our best efforts, no security measures are perfect or impenetrable.

 

10. Your EU Data Protection Rights

Location of Personal Information and Transfers. TrueSelf processes personal information on our servers in many countries around the world. We may process your personal information on a server located outside the country where you live. By using the Services, you freely and specifically give TrueSelf your consent to export your personal information outside of the EEA, including to the US and understand that data stored outside of the EEA may be subject to lawful requests by the courts or law enforcement authorities in the countries in which it is stored.

Access Requests. You have the right to request a copy of the your personal information we hold about you. TrueSelf will take commercially reasonable steps to provide you with such access and to correct, amend, or delete information that is demonstrated to be inaccurate or incomplete.

11. Changes to this Privacy Policy

From time to time, we may change this privacy policy to accommodate new technologies, industry practices, regulatory requirements, or for other purposes. We will provide notice to you if these changes are material.

12. Your California Privacy Rights

This Privacy Policy describes how we may use and share your personal information for marketing and other purposes. It applies to all users of the Services, including California residents.

As a California resident, you may contact us with any questions or request a list of third parties to whom we may disclose information for their own marketing purposes and the categories of information we may disclose.

13. Dispute Resolution

TrueSelf will investigate and attempt to resolve complaints and disputes regarding use and disclosure of Personal Information in accordance with the principles contained in this Privacy Policy.

 

If TrueSelf is unable to resolve your complaint, you can escalate the issue in accordance with the dispute resolution procedure set out in the “Governing Law and Arbitration; No Class Actions” provision in the Terms of Use.

14. Definitions

Aggregate Information. Aggregate information means information about groups or categories of users, which does not identify and cannot reasonably be used to identify an individual user. Aggregate Information is not personal information.

Anonymous Information. Anonymous information means information that does not directly or indirectly identify, and cannot reasonably be used to identify, an individual user.

Children. Children means individuals who we have identified are not of legal age to consent to the collection and processing of their personal information. For the purposes of this agreement, “children” are people under 13 in the United States, and anyone under 18 in any other jurisdiction.
